التنظيم القانوني للمسؤولية الناجمة عن مخاطر الذكاء الاصطناعي في نطاق المرتكزات المستحدثة

الملخص أصبح الذكاء الاصطناعي جزءاً لا يتجزأ من العديد من المجالات الحياتية للإنسان ، ومع هذه التطورات، برزت إشكاليات قانونية معقدة تتعلق بمسؤولية الأضرار الناجمة عن أنظمة الذكاء الاصطناعي، خاصة عندما يتصرف النظام بشكل مستقل دون تدخل بشري مباشر، وتُعد نظرية النائب الإنساني أحد الإطارات التقليدية التي تُطبق في هذا السياق. اذ يُنظر إلى الذكاء الاصطناعي على أنه أداة أو "نائب" يعمل نيابة عن الإنسان، وبالتالي تنتقل المسؤولية القانونية إلى الشخص الطبيعي أو المعنوي الذي يتحكم في النظام أو يستخدمه. ومع ذلك، فإن التحدي الرئيسي هنا يتمثل في صعوبة تحديد "الإنسان" المسؤول في الحالات التي يكون فيها النظام معقداً ومستقلاً إلى حد كبير. أما نظرية الوكالة فتنطلق من فكرة أن العلاقة بين الإنسان والذكاء الاصطناعي يمكن أن تكون مشابهة لعلاقة الموكل بالوكيل. إذا تصرف الوكيل (نظام الذكاء الاصطناعي) يكون ضمن الصلاحيات الممنوحة له، فإن أفعاله تُنسب إلى الموكل (صاحب النظام أو المشغل).
